Commercial Real Estate - Development, Acquisition and Disposition

DonovanFingar, LLC has extensive experience providing sound advice to the real estate development community as well as real estate investors. Members of the firm have been involved in the development, acquisition, disposition and financing of office buildings, retail projects, mixed use projects as well as industrial and warehouse facilities. By getting involved early in a project, we assist our clients in the due diligence phase of determining a project's feasibility. Our attorneys provide legal representation for the acquisition or disposition of the project, as well as advice concerning financing, construction, and development of a particular project. Because of our long background in the real estate industry, we have developed a significant expertise in IRC 1031 exchanges. We frequently provide advice and loan documentation with respect to mortgage backed financings subject to subsequent securitization under various CMBS programs.

Local & State Tax

The firm has significant expertise in local and state tax practice, including the protest and appeal of real and personal property valuation disputes and other types of disputes involving abatements, classification issues, exemptions from taxation and sales and use tax disputes. This practice includes trial at the circuit court level as well as review by the appellate courts. We regularly represent national and regional property owners involved in retail centers, healthcare facilities, apartment complexes and industrial and warehouse locations.

Commercial & Retail Leasing

The firm regularly represents commercial landlords with respect to drafting, negotiating and enforcing commercial and retail leases. The firm assists commercial landlords with wide-ranging leasing issues, as well as collections, unlawful detainer actions, and litigation.

Economic & Governmental Incentives

An outgrowth of the local and state tax practice has been the development of an economic and governmental incentives practice for organizations with new and expanding businesses in Alabama. This state wide practice consists of advising clients as to the myriad laws, appellate court decisions, regulations and revenue rulings in Alabama governing various state sponsored economic incentive programs. In addition to legal advice, the firm provides assistance in formulating and structuring proposals for clients seeking incentives as well as presentations to and lobbying of responsible state and local public officials. Clients include local and regional businesses seeking assistance with the economic incentive programs here in Alabama.

Homeowner Associations & Condominiums

Our attorneys have extensive experience representing condominium associations, homeowner associations, subdivisions, PUDs and management companies in a wide variety of legal matters. In addition, we represent condominium and residential developers in all facets of the development of condominium and subdivision projects. The firm represents the largest PUD development in the Jefferson - Shelby County area, as well as numerous property management companies, providing general advice and handling matters such as compliance, covenant enforcement, document preparation and collection of assessments.
